1. GENERAL PROVISIONS

1.1 User Scope

COPPA Compliance: Parental application for 18+ users only.

This Growo mobile application ("Application") may only be used by natural persons eighteen (18) years of age and older, on their own behalf and for the purpose of processing data of children under their guardianship. Direct use of the Application by persons under eighteen years of age is strictly prohibited.

The Application provides users with the following services:

This Application has not been developed for medical diagnosis, treatment, or health counseling purposes and is only for informational and parental support purposes.

The Application content does not replace the professional opinions of health professionals or physicians.

Users are obligated to consult with an authorized expert in the health field before using any information obtained while using the application as a basis for any medical intervention.

In emergency health situations, immediate application to the nearest health institution is required.

The Growo application cannot be held directly or indirectly responsible for health decisions made based on information provided by the user.

The user accepts and undertakes that they have read and understood the provisions of this Agreement and will use the Application within this framework.

2. USER OBLIGATIONS

2.1 Account Security

Users are obligated to ensure the confidentiality of passwords and other security information related to their accounts. Suspicious and unauthorized access should be shared with Growo immediately.

GDPR: Users can withdraw consent and delete data anytime.
CCPA: We don't sell personal information. Right to delete applies.

2.2 Providing Accurate and Current Information

Users are responsible for ensuring that all information they share within the Application is accurate, complete, and current. Any damages arising from providing false or misleading information are entirely the user's responsibility.

3. SUBSCRIPTION AND PAYMENT CONDITIONS

3.1 Pricing and Subscription

The basic features of the Application are free, while advanced ("premium") features are offered through monthly and/or annual subscription models.

Subscription fees are collected based on prices announced in application stores and may vary by country.

Value Added Tax (VAT) is included in prices.

3.2 Premium Services

The following services are provided within the scope of premium subscription:

3.3 Payment Transactions and Renewal

Subscription payments are made through Apple and Google payment systems.

Subscriptions automatically renew unless canceled.

Renewal dates and fees are notified to users in advance.

In case of disruptions in payment transactions, access to subscription features may be restricted.

3.4 Cancellation and Refund Policy

Users can cancel their subscriptions at any time.

Cancellation transactions must be performed through Apple or Google platforms.

After cancellation, service usage continues until the end of the subscription period.

Refund requests are evaluated within the framework of the policies and rules of the relevant platforms.

Automatic renewal is stopped after cancellation.

3.5 Promotions and Trial Periods

Promotions and trial periods are limited, and users can use these rights only once.

In case of misuse of promotions, Growo has the right to cancel promotions.

4. SERVICE LIMITATIONS AND DATA STORAGE

4.1 Service Continuity

Growo does not guarantee that services will be provided continuously and without errors.

Temporary interruptions in services may occur due to planned maintenance and updates.

Interruption periods are notified to users in advance whenever possible.

4.2 Service and Price Changes

Growo reserves the right to make changes in service content and pricing.

Important changes are notified to users in advance.

4.3 Storage and Destruction of Personal Data

Personal data is deleted within thirty (30) days at the latest when the processing purpose ceases or upon user request.

Periodic data destruction operations are performed twice a year, in June and December.

Data deletion, destruction, or anonymization operations are recorded.

Data is not stored longer than specified periods except for legal obligations.

5. INTELLECTUAL PROPERTY RIGHTS

5.1 Application Content

All content, brands, logos, designs, and materials related to the Growo application are protected by copyright.

Unauthorized copying, reproduction, distribution, and transmission to third parties is prohibited.

Ownership of content uploaded to the application by users belongs to the user.

5.2 Use of User Content

Photos, videos, comments, and other content uploaded by users may be used by Growo in a limited manner for the purpose of improving services.

Explicit consent is obtained from users for marketing and promotional uses.

Growo does not transfer user content to third parties and does not grant sublicenses.

5.3 Third Party Content and Data

Food and drug databases and AI analysis results in the application are owned by relevant third parties, and Growo does not guarantee the accuracy of this content.

6. NOTIFICATIONS AND COMMUNICATION

7. TERMINATION OF CONTRACT

7.1 Termination Reasons

7.2 Termination Procedure

Written notification is required.

Thirty (30) days are allowed from the notification.

User data is deleted after this period.

Subscription cancellation must be performed separately.

7.3 After Termination

All user data is permanently deleted.

Backups are also destroyed.

If any, subscription fee refunds are made according to relevant platform policies.

Application access is terminated.

8. ACCOUNT TERMINATION

8.1 User Termination

Users can delete their accounts at any time.

User data is deleted within 72 hours at the latest after receiving an account deletion request.

Subscription cancellation must be done separately.

8.2 Termination by Growo

Growo has the right to close user accounts in the following cases:

9. DISPUTE RESOLUTION

9.1 Priority Communication

The parties agree to contact the Growo support team first in case of disputes.

The support team commits to responding to requests within 48 hours at the latest.

9.2 Legal Remedies

Governing Law: User's local jurisdiction. Online mediation preferred.

For disputes arising from these conditions, the laws of the user's country of residence apply.

The parties accept mediation as the priority solution method.

Online dispute resolution platforms are preferred for international users.

10. MISCELLANEOUS PROVISIONS

10.1 Force Majeure

Growo cannot be held responsible for disruptions that may arise due to the following force majeure events:

The invalidity or unenforceability of any provision of this contract does not affect the validity of other provisions. Invalid provisions are replaced with the most legally compliant provisions.

11. UPDATING OF TERMS

Growo may update these terms of use by providing advance notice.

The user's continued use of the Application with updated terms means acceptance of the updated terms.
